1. Who is the seller?
The products presented on tintala.com (the “Tintala” shop) are sold by Lucas Frasson SCHERER, sole trader (entrepreneur individuel, EI), business name Printcraft, 60 rue François 1er, 75008 Paris, France — SIREN 992 677 864, RCS Paris 992 677 864, SIRET 992 677 864 00017 — VAT not applicable, article 293 B of the French General Tax Code (CGI).
Contact: contact@tintala.com.
In these terms, “we” means the seller and “you” means the customer, an individual buying for personal purposes (consumer).
2. Scope
These terms and conditions of sale apply to all orders placed on tintala.com by consumers residing in the European Union and delivered within the European Union. They are supplemented by our Delivery policy, our Returns and withdrawal policy and our Privacy policy. The applicable version is the one online at the time of your order. By confirming your order, you declare that you have read and accepted these terms and conditions of sale.
3. The products
Tintala sells non-corrective coloured contact lenses: they don't correct your eyesight.
- Contents: 1 pair = 2 lenses + 1 case.
- Period of use: yearly disposable, to be replaced 1 year after opening.
- Material: HEMA. Thickness: 0.04–0.06 mm.
- The result varies with your eye colour and the light.
Before any use, read the instructions supplied with the product carefully: in case of any difference, the instructions prevail. Before using lenses for the first time, ask an eye-care professional (ophthalmologist, optician or optometrist) for advice. Never lend your lenses to anyone. In case of pain, irritation, redness or blurred vision, remove the lens immediately and see a healthcare professional if the symptoms persist.
Products are offered while stocks last. Some designs are limited to 1 pair per customer: the limit is shown on the design's product page.
4. Prices and multi-pair offers
Prices are shown in euros. VAT not applicable, article 293 B of the French General Tax Code (CGI): the price displayed is the final price you pay. Standard delivery is included in the price: no delivery fee is added to the cart, and nothing is payable on delivery (any import duties and taxes are paid by us).
Multi-pair offers: on eligible designs, the Duo (2 pairs), Trio (3 pairs) and 10-Look Pack (10 pairs / 20 lenses) offers apply automatically in the cart, with any shades you choose. The cart always calculates the best combination of offers for the number of pairs chosen. Offer prices are shown on the website. Offers cannot be combined with other discounts.
The applicable price is the one displayed when you confirm your order.
5. Ordering
- You choose your designs and their quantities, then check your cart.
- You enter your contact details and your delivery address in the European Union.
- You choose your payment method and check the summary (products, quantities, total price, address).
- You confirm by clicking the final payment button: this click constitutes an order with an obligation to pay.
We then send you a confirmation e-mail summarising your order. Keep it: it serves as your durable medium. We may refuse or cancel an order in the event of a previous payment dispute, an abnormal order or suspected fraud; you are then refunded in full.
If an ordered product turns out not to be available, we let you know by e-mail and you are refunded without delay, at the latest within 14 days of payment of the sums concerned.
6. Payment
Payment is due when you order. It is secured by our payment provider: we never have access to your full card details. Accepted payment methods: bank card and the other methods offered on the payment page (for example Apple Pay or Shop Pay), processed by Shopify Payments.
7. Delivery
We deliver to all European Union countries (except the territories listed in our Delivery policy), from the time your order is confirmed and preparation included, within 3 to 5 working days for Halloween & cosplay lenses and within 5 to 12 working days for Everyday colours lenses; an order that includes both ranges is delivered within the longer delivery time at the latest. A tracking number is sent to you by e-mail. If your order has not been delivered 35 days at the latest after it was confirmed, you are refunded, without prejudice to your legal rights in the event of late delivery (articles L216-2 and L216-3 of the French Consumer Code). All the details (lost, late or damaged parcel) are in our Delivery policy.
The risk of loss of or damage to the products passes to you when you (or a person you have designated) take physical possession of the parcel.
8. Right of withdrawal
You have 14 days from receipt of your order to withdraw, without having to give any reason. You can exercise this right online from the “How do I withdraw from my purchase?” question in our FAQ (“Withdraw from the contract here” button, then “Confirm withdrawal”), by e-mail to contact@tintala.com, or with the model form annexed to our Returns and withdrawal policy. We send you an acknowledgement of receipt by e-mail without delay.
Legal exception (article L221-28 5° of the French Consumer Code): the right of withdrawal does not apply to lenses whose sealed sterile packaging (blister or vial) has been opened after delivery, for reasons of hygiene and health protection. Lenses whose sealed packaging is intact can be returned.
Return costs are paid by us. The refund is made no later than 14 days after receipt of your decision to withdraw, using the means of payment used for the order. The full terms are in our Returns and withdrawal policy.
9. Legal guarantees
All our products are covered by the legal guarantee of conformity (articles L217-1 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 to 1649 of the French Civil Code). In summary: you have 2 years from delivery to take action in the event of a lack of conformity, you only have to prove that the defect exists, and you can obtain repair or replacement of the product or, failing that, a price reduction or a refund. The guarantee against hidden defects can be invoked within 2 years of discovery of the defect.
The consumer has a period of two years from delivery of the goods to obtain the implementation of the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only has to establish the existence of the lack of conformity and not the date on which it appeared.
Where the contract for the sale of the goods provides for the supply of digital content or a digital service on a continuous basis for a period of more than two years, the legal guarantee applies to that digital content or digital service throughout the planned period of supply. During this period, the consumer only has to establish the existence of the lack of conformity affecting the digital content or digital service and not the date on which it appeared.
The legal guarantee of conformity entails an obligation for the trader, where applicable, to supply all updates necessary to keep the goods in conformity.
The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of the request, free of charge and without major inconvenience to the consumer.
If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.
If the consumer requests repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date on which the goods are replaced.
The consumer may obtain a reduction of the purchase price while keeping the goods, or terminate the contract and obtain a full refund in exchange for returning the goods, if:
1° The trader refuses to repair or replace the goods;
2° The repair or replacement of the goods takes place after a period of thirty days;
3° The repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer permanently bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods;
4° The lack of conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.
The consumer is also entitled to a reduction of the price of the goods or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. The consumer is then not required to request repair or replacement of the goods first.
The consumer is not entitled to termination of the sale if the lack of conformity is minor.
Any period during which the goods are out of use for repair or replacement suspends the remaining guarantee period until the restored goods are delivered.
The rights mentioned above result from the application of articles L. 217-1 to L. 217-32 of the French Consumer Code.
A seller who obstructs in bad faith the implementation of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (article L. 241-5 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for a period of two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept or to a full refund in exchange for returning the goods.
For any request under the guarantees, e-mail us at contact@tintala.com with your order number and, if possible, photos. We do not offer any commercial guarantee in addition to the legal guarantees.
